1. Agreement to Terms

By accessing or using the services provided by FREESTYLE LEARNERS PTY LTD (ABN 66 663 334 183) ("Company", "we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

We provide creative educational activity kits designed for schools, OOSH (Out of School Hours Care), and daycare centres across Australia. Our services include product sales, delivery, and customer support.

3. Orders and Payment

• All orders are subject to acceptance by Freestyle Learners.
• Prices are displayed in Australian Dollars (AUD) and are subject to change without notice.
• Payment must be received before order dispatch unless otherwise agreed upon in writing.
• We accept payment via bank transfer, credit card, or other methods as specified during checkout.
• You are responsible for ensuring all order details (delivery address, quantities, etc.) are correct before submission.

4. Delivery

• We deliver Australia-wide. Delivery timeframes are estimates and not guaranteed.
• Risk of loss and title for products pass to you upon delivery to the carrier.
• It is your responsibility to inspect products upon delivery and report any damage or defects within 7 days.

5. Returns and Refunds

• Products may be returned within 30 days of purchase if they are defective or not as described.
• Returns must be in original condition and packaging.
• Refunds will be processed within 14 days of receiving the returned products.
• Custom or personalized orders may not be eligible for return unless defective.
• Return shipping costs are the responsibility of the customer unless the product is defective.

6. Intellectual Property

All content on our website, including but not limited to text, images, logos, and product designs, is the property of Freestyle Learners PTY LTD and is protected by Australian and international intellectual property laws. You may not use, reproduce, or distribute our content without our express written permission.

7. Limitation of Liability

To the maximum extent permitted by law, Freestyle Learners PTY LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our products or services. Our total liability shall not exceed the amount paid by you for the product or service in question.

8. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (ACL) or any other applicable law that cannot be excluded, restricted, or modified by agreement. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of New South Wales.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
